Personal data refers to any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

II. Sources and Categories of Processed Personal Data

1. The controller processes personal data that you have provided or personal data obtained based on fulfilling your order.

2. The controller processes your identification and contact details and data necessary for contract fulfillment.

III. Legal Basis and Purpose of Processing Personal Data

1. The legal basis for processing personal data is:

  • fulfillment of the contract between you and the controller according to Article 6(1)(b) of the GDPR,
  • the controller’s legitimate interest in providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(f) of the GDPR,
  • your consent to processing for direct marketing purposes (especially for sending commercial communications and newsletters) according to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in cases where no goods or services were ordered.

 2. The purpose of processing personal data is:

  • processing your order and exercising rights and obligations arising from the contractual relationship between you and the controller; when ordering, personal data necessary for successful order fulfillment (name, address, contact details) are required. Providing personal data is a necessary requirement for concluding and fulfilling the contract. Without providing personal data, the contract cannot be concluded or fulfilled by the controller.
  • sending commercial communications and conducting other marketing activities.

 3. The controller does not conduct automatic individual decision-making within the meaning of Article 22 of the GDPR. You have expressly consented to such processing.

IV. Retention Period

1. The controller retains personal data:

  • for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the end of the contractual relationship),
  • until consent to processing for marketing purposes is revoked, for a maximum of 15 years if personal data is processed based on consent.

 2. After the retention period expires, the controller deletes personal data.

V. Recipients of Personal Data (Subcontractors of the Controller)

1. Recipients of personal data are:

  • persons involved in delivering goods/services/processing payments based on a contract,
  • providers of e-shop operation services (Shoptet) and other related services,
  • providers of marketing services.

 2. The controller does/does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing/cloud services.

VIII. Final Provisions

1. By submitting an order through the online order form, you confirm that you have read the personal data protection terms and that you accept them in full.

3. The controller is entitled to amend these terms. A new version of the personal data protection terms will be published on the controller’s website and sent to your email address.

 

These terms take effect on May 1, 2020.
